A firm protested an Air Force contract award to another firm for liquid oxygen-nitrogen generating plants, contending that the: (1) Air Force improperly awarded the contract without conducting any discussions; (2) evaluation criteria were ambiguous; (3) specifications were defective, since they did not comply with Department of Defense requirements for contamination-survivable systems; and (4) contracting officer erroneously advised it concerning the pricing of the first article. GAO held that the: (1) Air Force properly awarded the contract to the low bidder without discussions; (2) protester untimely protested alleged solicitation improprieties; and (3) protester was not prejudiced by the contracting officer's erroneous advice, since its bid would have remained high. Accordingly, the protests were dismissed in part and denied in part.
