A firm protested a Defense Logistics Agency (DLA) contract award for oximeters, contending that DLA improperly: (1) added solicitation requirements restricting offers to commercially available products without issuing an amendment or change notice; and (2) awarded the contract to an offerer whose product did not comply with minimum technical requirements. GAO held that: (1) the solicitation did not require that products be commercially available; (2) although DLA should have amended the solicitation to correct a deficiency, its failure to do so did not prejudice the protester, since there was no indication that the protester would have changed its offer; and (3) DLA properly determined that the awardee's product satisfied the specifications' intent. Accordingly, the protest was denied.
