A firm protested the Army's rejection of its bid as nonresponsive for failure to acknowledge a solicitation amendment, contending that: (1) its failure to acknowledge the amendment was immaterial, since it would comply with the amendment's requirements; and (2) the amendment form specified that bidders were not required to acknowledge the amendment. GAO held that: (1) the protester's failure to acknowledge the amendment was material, since the amendment concerned minimum wage rates; and (2) while the Army conceded that it made a clerical error on the amendment form, the solicitation specified that bidders were to acknowledge all amendments. Accordingly, the protest was denied.
