A firm protested a Department of the Interior contract award for dam construction, contending that: (1) Interior improperly evaluated its proposal; and (2) the awardee lacked the required experience and resources to perform the contract. GAO held that: (1) the protester untimely filed its contention concerning Interior's evaluation of its proposal; and (2) Interior properly considered the awardee's parent company's resources when it evaluated the awardee's proposal; and (3) it would not review Interior's determination of the awardee's responsibility, absent evidence that Interior acted fraudulently or in bad faith, or that it failed to properly apply definitive responsibility criteria. Accordingly, the protest was dismissed in part and denied in part.
