A firm requested reconsideration of the dismissal of its untimely protest against allegedly restrictive specifications in a solicitation for boiler repair. GAO had held that the protester untimely protested more than 10 days after bid opening, which constituted initial adverse agency action on the protester's agency-level protest. In its request for reconsideration, the protester contended that contract award, not bid opening, constituted initial adverse agency action. GAO held that its protest procedures specified that bid opening could constitute initial adverse agency action. Accordingly, the dismissal was affirmed.
