Highlights

A firm protested a Defense Logistics Agency (DLA) contract award for air duct hoses, contending that the awardee's equipment would not: (1) be compatible with existing DLA equipment that it manufactured; or (2) comply with the Buy American Act. GAO held that: (1) DLA had the responsibility to determine whether the offered equipment met its needs; (2) the protester was not sufficiently interested to protest; and (3) the protester abandoned its contention regarding the Buy American Act. Accordingly, the protest was denied in part and dismissed in part.
