The Immigration and Naturalization Service (INS) requested reconsideration of a GAO decision which sustained a protest against an INS contract award for telephone answering systems. GAO had held that INS improperly accepted the awardee's bid and should terminate the awarded contract. In its request for reconsideration, INS contended that: (1) since the awardee's descriptive literature did not take exception to the specifications, it properly accepted the awardee's bid; and (2) it could not terminate the completed contract. GAO held that: (1) INS untimely requested reconsideration; and (2) contract termination was not feasible. Accordingly, the request for reconsideration was dismissed and the recommendation withdrawn.
