A firm protested the Defense Logistics Agency's (DLA) rejection of its low bid as nonresponsive under a solicitation for copper tubing, contending that: (1) it submitted the low bid and sufficiently indicated its agreement to the solicitation requirements; and (2) DLA failed to send it a solicitation package. GAO held that: (1) DLA properly determined that the protester's bid was ambiguous and nonresponsive; and (2) there was no evidence that DLA attempted to exclude the protester from competition, and the protester did submit a bid despite its nonreceipt of the solicitation. Accordingly, the protest was denied.
