[Request for Reconsideration of Denial of Fraudulent Claim]

An Air Force employee requested reconsideration of the denial of his claim for per diem payments, contending that he was willing to forfeit his allegedly overstated expense claim, and should be entitled to the balance of the claim. GAO held that: (1) an investigation clearly showed evidence of fraud; (2) the fraudulent claim defeated his entitlement to per diem; and (3) the claimant could seek judicial relief. Accordingly, the request for reconsideration was denied.
