A firm requested reconsideration of the dismissal of its untimely protest against an Air Force contract award. GAO had held that the protester untimely filed its protest against the Air Force's use of negotiated procurement procedures after bid opening. In its request for reconsideration, the protester contended that it was unaware that the procurement was negotiated until after the Air Force made award. GAO held that, since the solicitation clearly stated that the procurement was negotiated and the Air Force requested best and final offers, it should have been apparent to the protester that the procurement was negotiated. Accordingly, the dismissal was affirmed.
