A firm protested an Army multiyear contract award under a small business set-aside for servomechanisms, contending that the Army improperly rejected its low bid as nonresponsive. The Army rejected the protester's bid because it proposed a separate price for production quantities without a first article. GAO noted that the solicitation: (1) only required level pricing of production quantities that included a first article; and (2) permitted a different price for production quantities without a first article. GAO held that the Army incorrectly interpreted the level-pricing provision and improperly rejected the protester's bid as nonresponsive. Accordingly, the protest was sustained, and GAO recommended that the Army terminate the contract and award it to the protester, if otherwise appropriate.
