A firm protested a Navy contract award to another firm for ship repairs, contending that: (1) the Navy improperly determined that it was nonresponsible; (2) the nonresponsibility determination effectively created a sole-source procurement; and (3) the Navy untimely filed its protest report. GAO waived the Navy's failure to timely file a protest report because: (1) the delay was partially due to inclement weather; and (2) the protester was not prejudiced because it had an opportunity to respond to the report. GAO held that the Navy: (1) complied with sole-source procurement requirements; and (2) reasonably determined that the protester was nonresponsible because it was not certified to work on nuclear propulsion systems and there was a high risk of performance delays. Accordingly, the protest was denied.
