The Department of Housing and Urban Development (HUD) requested a decision as to whether a former HUD employee was entitled to severance pay. GAO found that the Office of Personnel Management (OPM) downgraded the employee from GS-13 to GS-7, and he voluntarily terminated his permanent appointment with OPM to accept a temporary appointment with HUD. GAO determined that the employee was entitled to severance pay since his temporary employment was involuntary. Accordingly, the employee's severance pay should be computed using the basic rate at the time of the separation from his permanent GS-13 position.
