A firm requested reconsideration of the dismissal of its protest under an Army solicitation for natural gas. In the original protest, the protester had contended that: (1) the solicitation requirements were excessive; (2) the Army's cost comparisons were incorrect; and (3) the low bidder did not comply with regulatory requirements. GAO had dismissed the protest as untimely. In its request for reconsideration, the protester contended that it responded to the Army's report on its protest. GAO held that: (1) it would not reopen a protest where the protester failed to file its comments on the agency report in a timely manner; (2) the portion of the protest concerning solicitation improprieties was untimely since the protester filed it after bid opening; and (3) since the portion of the protest concerning the low bidder's compliance with regulatory requirements was based solely on innuendo, it would not conduct an investigation to establish whether the protester had a valid basis for protest. Accordingly, the dismissal was affirmed.
