A firm requested reconsideration of the dismissal of its protest against the Army Corps of Engineers' cancellation of a solicitation and the denial of its claim for reimbursement of its bid and protest preparation costs. In its request for reconsideration, the protester contended that: (1) GAO misread its submission as a protest against the solicitation's cancellation; and (2) the Corps violated applicable procurement regulations by proceeding with bid opening when it knew that the specifications were defective. GAO held that the protester: (1) did not show that the Corps acted in bad faith in proceeding to bid opening before cancelling the solicitation; and (2) was not entitled to reimbursement of costs, since the Corps did not violate any applicable statute or regulation. Accordingly, the prior decision was affirmed.
