The Navy requested reconsideration of a decision that sustained in part and denied in part a firm's protest of its solicitation for nuclear submarine overhaul. GAO had: (1) noted that the competition was unique because it was between a Navy shipyard and a private one; (2) sustained the protester's argument against the Navy's use of lowest target price as the sole evaluation criterion; (3) held that the Navy should have conducted some type of cost-realism analysis of the Navy shipyard's proposal; and (4) recommended that the Navy reimburse the protester for its protest costs. In its request for reconsideration, the Navy argued that it conducted a cost-realism analysis, so the payment of protest costs was inappropriate. GAO held that the Navy based its reconsideration request on information that it could have presented during the initial protest. Accordingly, the original decision was affirmed.
