The Defense Investigative Service (DIS) requested a decision regarding whether it could restore forfeited annual leave to the accounts of two retiring employees. DIS erroneously informed the employees that they were scheduled for mandatory retirement and, in anticipation of retirement, the employees accrued excess annual leave. A court ordered DIS to cease scheduling mandatory retirements only 2 weeks before the employees' scheduled retirement date, leaving the employees with only that time to schedule and use the excess leave. GAO held that, since the employees accrued the excess leave because of a DIS error, DIS could restore the forfeited leave to their accounts. Accordingly, DIS should restore the employees' leave accounts.
