[Protest of Any Navy Contract Award for Storeroom Operations]

A firm protested any contract award under a Navy solicitation for storeroom operations, contending that the Navy's evaluation method for normalizing material costs restricted competition. GAO found that, since the protest concerned an alleged solicitation defect and was filed after bid opening, it was untimely. GAO held that it would not consider the protest under the significant issue or good cause exceptions because: (1) the protest was not filed until 1 year after the Navy issued the solicitation; and (2) there was no compelling reason which prevented the protester from filing a timely protest. GAO also held that there was no basis for paying the costs of filing and pursuing the protest since it had not determined that the solicitation failed to comply with a statute or regulation. Accordingly, the protest was dismissed and the claim was denied.
