A firm protested a Defense Construction Supply Center contract award for fluid level control flush valves, contending that: (1) its lower priced product was improperly rejected, because it offered a product which was equivalent to the awardee's product; (2) its product was improperly evaluated because the agency failed to test it; and (3) there was a discrepancy in the awardee's bid concerning a prompt payment discount. GAO found that: (1) the agency had a reasonable basis to reject the protester's product because it failed to meet a material solicitation specification; (2) the agency was under no obligation to test alternate products; and (3) under federal regulations, prompt payment discounts are no longer considered in evaluations. Accordingly, the protest was denied.
