A firm requested reconsideration of a decision concerning its protest against a Defense Construction Supply Center (DCSC) procurement. In the previous decision, GAO held that the contracting officer should have referred his nonresponsibility determination of the firm to the Small Business Administration (SBA) for consideration under certificate of competency (COC) procedures. GAO found that: (1) DCSC had referred three nonresponsibility determinations to SBA concerning the protester under similar procurements, for which SBA declined to issue a COC; (2) SBA denied two of the protester's COC applications on the basis of its high delinquency record; (3) the three COC referrals which SBA denied within a month following the nonresponsibility determination were the basis for the contracting agency's decision; and (4) the protester had not shown any error of fact or law in the prior decision which would warrant its reversal. Accordingly, the prior decision was affirmed.
