[Protest of Negative Responsibility Determination Under DISC Small Purchase]

A firm protested the Defense Industrial Supply Center's (DISC) determination that it was nonresponsible under a procurement that was conducted under small purchase procedures. DISC noted that, since the protester was a small business, it had referred the matter of the the protester's responsibility to the Small Business Administration (SBA) for consideration under certificate of competency procedures even though small purchase procedures did not require it to do so. GAO held that: (1) it would not interfere with the SBA determination of the protester's responsibility; and (2) a recently enacted law required SBA referrals for small business responsibility determinations even under small purchase procedures. Accordingly, the protest was dismissed.
