A firm protested the award of a delivery order under a Marine Corps solicitation for office furniture, contending that the awardee's commercial price list did not name all of the items it intended to supply as the solicitation required. GAO held that the protest was academic because the Marine Corps subsequently decided to terminate the awarded contract and resolicit for the required items because it found the awardee's bid to be nonresponsive in several respects. Accordingly, the protest was dismissed.
