The Air Force questioned a Claims Group determination to recredit an employee's annual leave account with 84 hours which had been forfeited from his account after his suspension and subsequent return to work. GAO has held that an employee who cannot use paid annual leave during a period of suspension from duty is subject to a maximum leave carryover limitation and is liable to forfeit annual leave in excess of the amount allowable at the beginning of the next succeeding leave year. GAO found that the Claims Group determination to recredit the employee's annual leave account was incorrect. Accordingly, the Claims Group determination was overruled and the employee's claim was disallowed.
