A firm protested any Navy contract award to either of two other firms under a solicitation for refuse collection. The protester contended that the two firms failed to arrive at their bid prices independently and are closely held corporations. GAO has held that collusive bidding is a matter of bidder responsibility and will not challenge affirmative determinations of responsibility absent a showing of fraud or bad faith. Accordingly, the protest was dismissed.
