A firm renewed its protest against a Federal Aviation Administration (FAA) contract award for the rehabilitation of ramp taxiways. Subsequent to its original protest with GAO, the firm filed suit in a federal court, and GAO dismissed the protest. The firm protested the Attorney General's initial refusal to recognize the Competition in Contracting Act relative to the suspension of award or performance pending resolution of bid protests. GAO would not consider that protest since it involved a subject of litigation before a court of competent jurisdiction. GAO: (1) held that the court did not request for a GAO opinion; and (2) would not consider the protester's offer to withdraw its suit to reopen the GAO protest. Accordingly, the protest was dismissed.
