A firm protested a Defense Logistics Agency (DLA) solicitation for tents, contending that DLA should have issued the solicitation as a small business set-aside. GAO held that the protest was academic because: (1) DLA referred the matter of the protester's responsibility to the Small Business Administration, which determined that the protester was not a small business; and (2) the protester was not prejudiced by the issuance of the solicitation on an unrestricted basis. Accordingly, the protest was dismissed.
