An advance decision was requested regarding a voucher presented to the National Mediation Board (NMB) for payment for the services of an arbitrator. The voucher was signed by the arbitrator, but he requested that payment be made to a corporation of which he was the sole officer and owner. NMB questioned this form of payment because it had not previously made payment for such services to a corporation and the services were performed by the individual. Accordingly, since NMB hired and used the services of the individual, he should be paid as an individual rather than as a corporation. However, in the future, if a professional corporation is engaged to perform the services and does so, it may be paid for performing in that capacity.
