A firm requested reconsideration of the dismissal of its protest which contended that the Forest Service had failed to comply with the evaluation criteria set forth in a solicitation and unreasonably evaluated its offer. The protest was dismissed because GAO did not receive the protester's comments on an agency report within 7 working days after GAO received the report. The attorney for the protester stated that the comments were late because of the late receipt of the report. Accordingly, since the burden is on the protester or his attorney to inform GAO within 7 days if it does not receive an agency report and the protester failed to notify GAO within the required time period, the prior decision was affirmed.
