The Department of Energy (DOE) requested an advance decision regarding the status of five consultants. Specifically, DOE questioned whether they should have been considered intermittent employees which would allow for reimbursement of transportation and per diem costs. GAO concurred with the Office of Personnel Management (OPM) determination that the consultants should have been considered intermittent employees and that OPM properly held that a consultant's service year limitation relates to the number of days worked in a specific position. Accordingly, since DOE intended to hire the consultants as intermittent employees for a period not exceeding the service year, they were entitled to the claimed per diem and transportation expenses.
