A member of the Army Reserve requested reconsideration of a Claims Group settlement of his claim for additional amounts of military pay and allowances for an injury he received while serving on active duty. The member had previously been paid for some of the time for which he was hospitalized but renewed his claim indicating a longer period of illness. GAO has held that the right to active duty pay is based on the injured party's ability to perform his duties and administrative determinations of the extent of the disability. GAO found that there was no evidence that the appropriate administrative determination had been made as to whether the member was actually incapacitated during the time he claimed. Accordingly, the Claims Group's settlement was sustained.
