A firm protested the Air Force's intention to ignore the Small Business Administration's (SBA) ruling on the protester's status as a dealer of a solicited item as guiding its own ruling of the protester's approved source status. GAO held that an SBA ruling would merely determine the protester's status as a dealer under the Walsh-Healey Act and that its approved source status was to be determined by the agency. Further, the rulings involved different considerations; therefore, the SBA ruling would not determine the agency's approved source determination. GAO also held that the protester's argument that the approved source determination should have been referred to SBA was premature since the determination had not yet been made. Accordingly, the protest was denied in part and dismissed in part.
