A firm protested the Department of Energy's (DOE) sale of a petroleum reserve facility, arguing that: (1) DOE issued a defective invitation for bids (IFB) because it did not contain the best current petroleum price estimate; and (2) DOE should have issued an amendment to the IFB immediately after the protest was filed. GAO noted that DOE has a certain amount of discretion in the sale of reserve petroleum products, including the decision as to the amount of gas to sell and for what price. GAO held that DOE acted properly in its price decision because it believed in good faith that the IFB reflected the best available cost estimate. GAO also held that DOE could not have timely issued an amendment without delaying the sale and that any delay would have had an adverse effect on facility operations. Accordingly, the protest was denied.
