A Department of Energy employee claimed overtime compensation computed under the Fair Labor Standards Act (FLSA) for work outside regular duty hours performed with the knowledge of her superiors and additional amounts computed under the federal regulation applicable to overtime work performed under official orders or approval. GAO found that the record did not contain evidence of overtime officially ordered or approved. Under the circumstances, GAO concluded that the employee's supervisors did no more than suffer or permit her overtime work. While GAO found that the employee was entitled to be paid FLSA overtime compensation, her claim for additional overtime compensation was denied.
