A firm requested reconsideration of a decision which denied in part and dismissed in part its protest of a Veterans Administration (VA) contract award. In the prior decision, GAO held that VA properly rejected the protester's bid as nonresponsive to a solicitation requirement. In its request for reconsideration, the protester stated that the product it offered conformed to the specifications. However, responsiveness must be determined from the bid as submitted. Although the protester argued that the deviations of its product were insubstantial, GAO found that the deviations were material since they concerned the quality of the product offered. Further, a nonresponsive bid may not be accepted even though it would result in monetary savings to the government. Finally, GAO would not review its decision that a protester allegation that a solicitation amendment was unduly restrictive was untimely filed since the protester failed to provide new evidence or legal arguments. Accordingly, the prior decision was affirmed.
