A firm protested a Federal Prison Industries contract award, contending that the award was improper because the equipment offered by the awardee did not meet the specifications. The agency acknowledged that the awardee's equipment did not comply with a number of the specifications; however, from descriptive literature provided, it determined that the points on which the awardee did not meet the specifications were not critical and that the awardee's equipment could perform the required operations. However, a contracting agency may not waive an advertised specification if a deviation goes to the substance of the bid or works an injustice to other bidders. In this case, price was affected; therefore, GAO found that the contract award was improper. Accordingly, GAO sustained the protest; however, no remedial action was practicable because the equipment had been delivered. GAO recommended that this matter be brought to the attention of the agency's procurement personnel.
