A firm protested the rejection of its low bid and the subsequent award of a contract to another firm under a Veterans Administration (VA) solicitation, contending that: (1) its product satisfied the requirements of the solicitation and was the lowest priced product offered; (2) its product was not inferior to that procured; (3) the person who performed the evaluation of the products was not qualified; and (4) the product procured was not manufactured in the United States. GAO held that: (1) VA acted within its discretion in determining that the higher priced product was technically superior; (2) the choice of evaluators was within the agency's discretion; and (3) the part of the protest alleging that the product procured was foreign-supplied was untimely filed. Accordingly, the protest was denied in part and dismissed in part.
