[Protest of Navy Determination That Technical Proposal Was Unacceptable]

A firm protested a determination by the Navy that its technical proposal was unacceptable. The protester also alleged that the Navy: (1) improperly selected a higher priced offerer for prospective award without selecting a competitive range or conducting discussions; and (2) improperly canceled the solicitation after a cost comparison which determined that the required services should be retained in-house. GAO held that the Navy properly found the protester's proposal to be deficient. GAO also held that: (1) the solicitation specified that the competitive range would include all offerers with a reasonable chance of award and that award might be made without discussions; and (2) the protester was not an interested party under bid protest procedures for the purpose of protesting the cost comparison because it was not in line for award. Accordingly, the protest was denied in part and dismissed in part.
