A firm protested a contract award to another firm by the Navy, contending that a solicitation specification was ambiguous. The protester wrote to the Navy 1 week before bid opening, requesting clarification of the solicitation. The Navy stated that it never received the letter. GAO held that the protest was untimely filed, since it was not received by GAO until after the bid opening date. GAO noted that bidders and protesters make use of the mails at their own risk, except under circumstances not relevant to this case. Accordingly, the protest was dismissed.
