An individual protested the award of a contract by the Forest Service, contending that he was deprived of the opportunity to bid on the contract because he did not receive a copy of the solicitation. The protester contacted the Forest Service to request that he be placed on the bidders list, but it did not have an established bidders list for the requirement. The Forest Service advertised the procurement in the Commerce Business Daily and other publications. GAO held that, since the protester did not allege or demonstrate that the Forest Service deliberately or consciously attempted to exclude him from competition, there was no impropriety. Accordingly, the protest was denied.
