A firm protested the rejection of its bid under an invitation for bids issued by the Defense Fuel Supply Center to supply coal to an Air Force base. The protester contended that its failure to indicate that it would supply oil-treated coal was an inadequate basis for rejection of its bid because it was supplying oil-treated coal to the base under a prior contract. GAO has held that, where a bidder is advised of its unacceptable bid and the reason for its rejection, a protest based on that rejection must be filed within 10 working days of the receipt of the notice. GAO stated that the firm's protest was untimely since it was filed more than a month after it received notice of contract award. Accordingly, the protest was dismissed.
