Two firms protested the possible award of a Navy small business set-aside, arguing that the awardee was not responsible. The first protester also contended that the second protester did not qualify as a small business. GAO noted that, since the Small Business Administration (SBA) has conclusive authority to determine a firm's size status, it would not consider the protests. Further, SBA issued a Certificate of Competency to the second protester which caused the first protester's remaining argument to be academic. Accordingly, the protests were dismissed.
