A firm protested the Air Force's intention to award a 100-percent small business set-aside contract for marine utility and tugboat services to another firm. The protester challenged the propriety of a provision of the request for proposals which allowed offerers to subcontract up to 100 percent of the work to large businesses and did not preclude subcontracting to the large business incumbent contractor. In an earlier protest, the firm had questioned the proposed awardee's responsibility and the propriety of the Air Force's evaluation of the proposals. GAO found that: (1) for purposes of the issues raised in the initial protest, the protester was not an interested party, since SBA had disqualified it as a small business; and (2) the second protest was untimely filed under bid protest procedures. Accordingly, the protests were dismissed.
