A firm protested a contract award by the Naval Facilities Engineering Command. The protester alleged that, not only was the awardee unqualified to perform the contract, but it did not have the requisite State license. GAO held that: (1) absent a solicitation provision requiring bidders to possess a specific license, a bidder's lack of a State license would not bar a contract award; and (2) an agency's affirmative determination of bidder responsibility is not reviewed by GAO except in limited circumstances not present in this case. Accordingly, the protest was denied in part and dismissed in part.
