A firm requested a second reconsideration of a decision which denied its protest regarding the Corps of Engineers' intention to continue a total small business set-aside for dredging services. The protester argued that, since a substantial portion of the procurement involved new work, the Corps of Engineers could not show a prior history of successful acquisition of services for this work. The protester contended that this was a prerequisite to the continued set-aside of the dredging services. GAO found the protester's arguments to be without merit, and it held that the protester failed in its second request for reconsideration to raise new issues of fact or to demonstrate errors of law which would cause a review of the initial decision. Accordingly, the request for reconsideration was denied.
