[Protest of Any Award Under Air Force RFP]

A firm protested any award of an Air Force contract for a cable television franchise, arguing against the Air Force's determination that it was nonresponsible because it lacked the financial capability to perform the contract. The protester also asserted that the Air Force sent it the wrong forms for proving that it had the necessary financial backing. GAO noted that the protester was given approximately 6 weeks to provide the Air Force with proof of its financing and, despite several assurances by the protester that financing would eventually be secured, the proof was not forthcoming. Further, the Air Force sent a personal financing guaranty form to the protester, rather than the usual bank guaranty form, because the protester had indicated that an individual would be financing the contract. GAO held that the contracting officer provided ample opportunity for the protester to establish its financing and that the nonresponsibility determination was reasonable. Accordingly, the protest was denied.
