A firm protested a contract award by the Navy to another firm, alleging that the solicitation specifications did not reflect the Navy's actual needs and that the agency should have accepted the protester's proposal to repair existing equipment rather than replace the equipment as called for in the solicitation. GAO held that the first part of the protest was untimely because it was not received by GAO within 10 days of the closing date for receipt of proposals by the Navy. Further, GAO held that the second part of the protest was untimely because it was not received within 10 days of the closing date for best and final offers. Accordingly, the protest was dismissed.
