A firm requested reconsideration of a decision which dismissed as untimely its protest of a Department of Transportation contract award. The requester argued that it did not actually protest the award and that it was unaware of the bid protest procedures timeliness requirements. GAO held that the requester knew of the basis of its protest more than 10 working days before its initial complaint but failed to file its protest within that time. Therefore, the timeliness requirements were not met. GAO also held that bid protest procedures are published in the Federal Register and that all protesters are charged with constructive notice of their contents. Accordingly, the prior decision was affirmed.
