An individual protested the qualifications contained in a Forest Service solicitation for seed cone collection. The protester argued that the qualifications resulted in the third lowest bidder's receiving the award for the second item in the solicitation. The protester also complained that the qualifications did not adequately address themselves to the solicitation. GAO held that, since the protester failed to complete his bid for the second item, the Forest Service properly rejected that part of the bid and made award to the next eligible offerer. Further, the protest was untimely because the disputed qualifications were apparent prior to bid opening, and the protest should have been filed before that time. Accordingly, the protest was denied in part and dismissed in part.
