A firm protested a Defense Supply Service (DSS) sole-source contract award for spare parts, arguing that DSS did not give it an opportunity to qualify as a viable source of the spare parts. GAO held that pending litigation against the protester's reliability properly prompted DSS to cautiously avoid considering the firm. Further, the protester did not demonstrate that it could meet the needs of DSS. Accordingly, the protest was denied.
