A firm protested a set-aside contract award to another firm by the Naval Electronic Systems Command under a resolicitation for a requirement for which the protester had originally been the awardee. The central issue of the protest was that the technical and cost evaluation was biased and improper. GAO held that the award, which was based primarily on cost savings, was proper because the contracting agency reasonably considered the proposals to be technically equal. GAO stated that the allegations of bias were not proven by the protester and that the other contentions were not within its jurisdiction. Accordingly, the protest was dismissed in part and denied in part.
